General Terms and Conditions (GTC)

1. Scope of application

Horseandmore.ch is a service provided by Horseandmore GmbH, 8865 Bilten

Horseandmore GmbH, 8865 Bilten (hereinafter referred to as "Horseandmore.ch") shall provide all deliveries and services for orders placed in the Horseandmore.ch online shop exclusively on the basis of these GTC, in the version valid at the time of the order. By sending an order, the Client accepts the GTC. Online ordering shall only be possible in Switzerland and Liechtenstein. Horseandmore.ch and the Customer reserve the right to enter into individual written agreements that deviate from these GTC.

2. Products

Product information in the Horseandmore.ch online shop is non-binding and no liability shall be assumed for the accuracy, completeness or up-to-dateness of the information. Information may be changed by Horseandmore.ch at any time. Similarly, quality standards, botanical designations, indications of origin, samples and specimens of products are non-binding and may be changed at any time.

3. Prices

All prices are quoted in Swiss francs and include VAT. Prices are for unpacked goods excluding shipping costs. We reserve the right to change prices at any time.

Items already reduced are not eligible for further discount.

4. Orders

Orders shall be placed online on the Internet order page of the Horseandmore.ch online shop. The offers in the Horseandmore.ch online shop shall be deemed merely to be an invitation to submit an offer. The customer's order shall be binding on the customer. The Customer shall be responsible for the online order and the order shall be processed as it is received by Horseandmore.ch without the Customer being consulted.

Horseandmore.ch shall be free to refuse to process an order at any time without stating reasons. A purchase contract shall only be concluded once Horseandmore.ch has dispatched the ordered products or confirmed dispatch to the Customer. Horseandmore.ch shall accept no liability whatsoever for transmission errors or incorrect computer entries by the customer.

The Customer shall not be entitled to withdraw from the order in the event of transmission errors or incorrect entries on the computer.

5. Availability

Horseandmore.ch does not guarantee the availability of ordered products and reserves the right not to deliver ordered items, e.g. if they are not available or not available in full. Horseandmore.ch shall provide information on the invoice about any items that are not available and therefore not delivered. Horseandmore.ch shall not subsequently deliver any undelivered items once they become available and the Client shall be required to place a new order, if desired.

Horseandmore.ch reserves the right to deviate from the order in the event that a product is not available at short notice and another available product has equivalent properties to the one ordered.

6. Terms of delivery

The delivery time depends on the circumstances. Delivery dates and deadlines are non-binding indicative times. The customer cannot derive any rights from their non-compliance. The customer is obliged to accept and pay for the goods. Delivery shall be made by Swiss Post, DHL or, in the case of palletised goods, by forwarding agent.

The minimum order value is CHF 30. Below the minimum order value, a small quantity fee of CHF 9.-- will be charged.  The shipping costs (postage and packaging material) will be invoiced. 

(For resellers, a minimum quantity fee of Fr. 15.-- will be charged for an order value below Fr. 70.--. Delivery free of charge from a final amount of Fr. 200.- and for max. 30 Kg)

Deliveries by DHL or Swiss Post

The online ordering option is only available for the territory of Switzerland and Liechtenstein.

7. Terms of payment

The customer has the option of paying the amount owed by Paypal, TWINT, prepayment, invoice, credit card, Maestro or Postcard .

Products containing CBD cannot be paid by credit card or Maestro for legal reasons.

7.1 Order on account

Ordering on account is not activated for new customers. 

Horseandmore.ch reserves the right to change the payment method  "on account" to prepayment. 

The invoice must be paid within 30 days of the order date. Due invoices must be paid before new delivery. In the event of late payment, Horseandmore.ch may suspend the subsequent order. 

7.2 Interest on arrears Invoice

Invoices must be paid within 30 days of the invoice date at the latest. Late payments shall be subject to interest on arrears of 5 % (but at least CHF 10.-) of the total amount. In case of overdue payments, new orders will be suspended. Overdue payments will be forwarded to our collection partner after the 2nd reminder. This is associated with additional fees.

8. Right of withdrawal and return of goods

Goods which the customer has received in response to his order may be returned by the customer to Horseandmore.ch within 14 days of receipt with a brief statement of reasons, provided that the goods are unused, in their original packaging and in perfect condition.

Trying on and returning items in use, such as riding clothes, horse blankets, etc., shall only be permitted under reserve. Returned items will only be refunded if the item is returned in absolutely perfect condition and without any signs of use. The price tags and labels may not be removed from items to be returned, and the original packaging (e.g. packaging cover for horse blankets) must still be present. The removal of the labels and price tags obliges the customer to purchase!

The return of the goods is considered as a revocation of the order. The return of the goods shall be at the expense, liability and risk of the customer, unless there has been an incorrect delivery on the part of Horseandmore.ch.

Discounted items and items from Sale may not be returned.

Any postage costs incurred and payment fees charged by payment service providers (such as Paypal) cannot be refunded. 

The right of withdrawal does not apply to goods that are made to the customer's special specifications, are quickly perishable or whose expiry dates have passed.

Returns shall be made to: Horseandmore GmbH, Grindwiesstrasse 4, 8865 Bilten. If Horseandmore.ch has no outstanding invoices with the Customer, the credit note shall be paid out to the Customer at the latter's request.

9. Retention of title

Goods ordered by the Customer shall remain the property of Horseandmore.ch until full payment of the price and all costs incurred, including interest on arrears. Horseandmore.ch shall be entitled to enter the retention of title in the retention of title register at the customer's place of residence. In the event that the customer defaults on payment of the purchase price, Horseandmore.ch shall be entitled to withdraw from the contract without further ado and to take possession of the goods.

10. Exclusion of liability and warranty

Horseandmore.ch shall not accept any liability for errors in illustrations, prices, texts or due to late delivery or failure to deliver. Upon handover of the goods to the carrier, Horseandmore.ch shall have fulfilled all obligations arising from the customer's order and the benefit and risk in respect of the goods shall pass to the customer. In particular, Horseandmore.ch shall not be liable in the event that the goods are not handed over directly to the client by the carrier, but are instead deposited on the client's doorstep, with a neighbour or similar in the latter's absence. The client shall be obliged to inspect the goods immediately upon receipt and to notify Horseandmore.ch in writing of any defects within seven days of receipt of the goods. In the event of defects, the customer shall only be entitled to demand a replacement delivery or a reduction in the purchase price, whereby the customer shall not be entitled to these rights in the event of minor defects. In all other respects, any warranty on the part of Horseandmore.ch shall be excluded to the extent permitted by law. Furthermore, Horseandmore.ch shall not assume any warranty whatsoever in connection with its website, neither for its content nor for the website being available to the Customer or third parties.

The information provided on Horseandmore.ch regarding indications, treatment methods, therapies, etc. is not suitable or intended to replace the advice of a veterinarian. Liability is excluded. Horseandmore.ch shall not be liable for damage caused by failure to observe the recommendations for use and dosage. Liability is also excluded for animals with allergies and other specific diseases. In case of doubt, it is recommended to consult a veterinarian.

Horseandmore.ch shall accept no liability whatsoever as a result of intolerances to feed and care products or  alleged deterioration in the health of products purchased from Horseandmore.ch.

Customers who take part in official competitions with their animals must inform themselves of the permissible or non-permissible substances from the relevant organisations. Horseandmore.ch declines all liability.

11. Security and data protection

The personal customer data required for the processing of orders shall be stored by Horseandmore.ch and treated confidentially. If necessary for order processing, the data may be passed on to companies associated with Horseandmore.ch. Customer payments in the Horseandmore.ch online shop shall be made in a protected area in which the data is transmitted in encrypted form. Customer data shall be treated confidentially and shall not be passed on to third parties for advertising purposes. Horseandmore.ch accepts no liability whatsoever for the security of the data transmitted  

All image material used by Horseandmore.ch is protected by copyright and may only be used by the Client with the consent of Horseandmore.ch.

12. Disclaimer for external links

Horseandmore.ch websites may contain links to third-party websites. Third-party websites may refer to Horseandmore.ch websites. Horseandmore.ch accepts no responsibility for such websites and their content, for their products, services or other offers, nor for their compliance with data protection regulations, and distances itself from them. The activation of a link is at the user's own responsibility.

13. Applicable law and place of jurisdiction

The legal relationship between the client and Horseandmore.ch shall be governed by Swiss substantive law. The place of jurisdiction shall be Bilten, although Horseandmore.ch shall also be entitled to bring an action at the Client's place of business. The place of business of Horseandmore.ch or Horsandmore GmbH, Bilten shall be the place of performance.

 

Entry into force

These GTC shall come into force on 24.08.2022. They shall replace all GTC of Horseandmore.ch, Horseandmore GmbH, 8865 Bilten valid up to that date.
